In Brazil, the social demand for veterinary expertise is growing. However, there is still a shortage of professionals trained in this area to apply specific knowledge to each case. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. The history of Christianity was a prevalent subject among 18th century philosophers. This article presents a historical perspective of the relationship between Christianity and power based on a comparative analysis of the ideas of Voltaire and Rousseau. Bibliographic research was undertaken using a philosophical approach to their works. This study examines Voltaire’s inquiry into Jesus Christ as a historical figure and a“genealogy” of Christianity in three of his works: Tumbeau du fanatisme(1736), Traité sur la tolérance(1763), and Catéchisme de l'honnête homme (...) (1763). Regarding Rousseau, this study interprets his historical approach to the connections between Christianity and politics based on the following works: Sur la Réponse qui a été faite à son Discours(1751), the chapter entitled “Civil Religion” in Du Contract social(1762), and Lettres écrites de la montagne(1764). Not only do the findings of this inquiry reveal the similarities and differences between the thoughts of Voltaire and Rousseau and the historical tensions between Christianity and power, the findings also point toward a fundamental defense of a secular state. CAVALCANTI NETO, Lamartine de Hollanda. Contributions of Thomistic Psychology to the study of the plasticity of the ethos. 2012. 571s. Thesis (Doctorate in Bioethics) – Centro Universitário São Camilo, São Paulo,2012. If Ethics is not a static science, it is because ethos — its basic object of study — is a mutable reality. For this reason, ethical themes, chiefly those of Bioethics, are directly related to the study of the plasticity of the ethos. Nevertheless, such investigation requires that the (...) researcher distance himself from concrete ethical questions, to apply himself to the theoretical examination of what enables the existence and development of such questions — that is, the aforementioned plasticity. However, bibliographical literature on this subject has revealed a scarcity of works focused specifically on the theme. This scarcity seems to indicate that the subject is still in a process of methodological definition. Therefore, we propose as a research question, to investigate at the theoretical level, if Thomistic Psychology can be considered a valid study tool for the plasticity of ethos. For this aim, we adopt a documental and bibliographical research methodology adapted to the aforesaid question, based on the presupposition that such validity can be gauged to the extent that Thomistic Psychology offers objective contributions to the study of the plasticity of the ethos. Backed by extensive literature, we present an overview of Thomistic Psychology, as well as of ethos and its plasticity. With the data obtained, we establish a discussion with a view to identifying these contributions. Based on the results, we close with a reply, while still open, to our research question, hoping to afford, in this way, a kind of platform on which new studies can be developed with greater facility. Questioning the reasons that led Augustine to reflect about time, a theme often associated with metaphysics and cosmology, in his work Confessions, which main character is autobiographical, we hypothesized that the theme belongs to the unitary project of the work, whose keys of reading would be 1) the purpose of human life and 2) the distinction between God and creatures. When analyzing the Augustinian argument, it is noticed that it is possible to insert the debate in question in the general (...) scope of the narrative of this specific work. It is also noticed that, from this perspective, the psychological approach is not necessarily linked to an understanding of time from a purely subjectivist aspect, since the central concern of the discussion is not with the metaphysical / cosmological aspect, but with the analysis interior. Apresentaremos primeiro o ideal da ausência de valor (seção 2), o que Townsend entendia por medidas objetivas e subjetivas (seção 3) e então poderemos compreender melhor o que é e quem não concorda com a posição de que a pobreza (...) é um juízo de valor (seção 4). O presente artigo pretende mostrar como o filósofo e ensaísta de sobrenome árabe, origem judia e religião católica Fabrice Hadjadj se utiliza de dois autores italianos, a saber, Dante Alighieri e Lorenzo da Ponte, para aprofundar as suas reflexões sobre a noção de Paraíso. No primeiro caso, Hadjadj elabora um encontro entre Dante e Nietzsche, articulando uma compreensão de Paraíso que, na perspectiva hadjadjiana, ultrapassaria as críticas de Friedrich Nietzsche. No segundo, o autor explora o conceito de “redenção”, presente na (...) ópera “Don Giovanni”. Após a exposição da interpretação do filósofo em cada caso, constatamos que a leitura de Dante promove, para Hadjadj, um deslocamento do paraíso do exterior para o interior e que Don Giovanni explicita, segundo Hadjadj, a dinâmica redentora do Paraíso, à medida em que o convite à máxima felicidade não é fruto de uma conquista pessoal ou do cumprimento de um preceito moral, mas um dom que vem do Alto. Finalmente, constatamos o caráter transdisciplinar da leitura que Hadjadj faz de Da Ponte e Dante, considerando-os como autores cujas obras exprimem realidades profundas que precisam ser desveladas e que podem envolver e auxiliar àqueles que leem o texto contemporaneamente. A recent paper by Jakl, Jung and Pultr succeeded for the first time in establishing a very natural link between bilattice logic and the duality theory of d-frames and bitopological spaces. In this paper we further exploit, extend and investigate this link from an algebraic and a logical point of view. In particular, we introduce classes of algebras that extend bilattices, d-frames and N4-lattices to a setting in which the negation is not necessarily involutive, and we study corresponding logics. This chapter connects the phenomenon of double bookkeeping to two critical debates in the philosophy of delusion: one from the analytic tradition and one from the phenomenological tradition. First, I will show how the failure of action guidance on the part of some delusions suggests an argument to the standard view that delusions are beliefs (doxasticism about delusion) and how its proponents have countered it by ascribing behavioral inertia to avolition, emotional disturbances, or a failure of the surrounding environment in (...) supporting the agent’s motivation to act. Second, I will show how the mismatch between the experience of double bookkeeping and that of having the usual propositional attitudes of folk psychology suggests another, more recalcitrant argument not only against doxasticism but against the very attempt to fit delusion into folk psychology. Third, I will show how phenomenologically inspired theories of delusion, such as the multiple realities hypothesis, bypass the debates above and focus on describing and understanding the disturbances in the structure of experience undergone by patients. I conclude that the philosophical discussions ensuing from an appreciation of double bookkeeping show some of the limitations of the analytic philosophical approach to delusion. (shrink)

A partir de la tesis del filósofo español Miguel de Unamuno (1864-1936), según la cual el extremo occidental — Portugal — y el extremo oriental — India — se dieron las manos espirituales por vía de la comprensión de la vanidad del mundo (vanitas), presentada en su obra Por tierras de Portugal y España (1911), nos proponemos poner en diálogo las visiones del mundo barroco occidental y del mundo budista oriental sobre la vanidad y la muerte. O presente artigo objetiva fornecer uma apresentação crítica, compreensiva e inédita na língua portuguesa do Processamento Preditivo (PP) – um esquema teórico para a compreensão da cognição que propõe uma inversão de nosso entendimento padrão da ação, percepção, sensação e sua relação. Aqui, nosso objetivo primário será introduzir os principais conceitos e ideias do PP, tratando-o como um modelo moderadamente corporificado de cognição e analisando suas credenciais como uma proposta teórica unificadora. Para tanto, partiremos de uma contextualização histórica de algumas (...) correntes de pensamento que teriam fomentado seu desenvolvimento inicial, passando por uma descrição não-matemática do Princípio da Energia Livre, que fundamenta e subentende a atuação de suas especificidades para, então, esclarecermos o papel que, segundo o PP, a inferência bayesiana, a minimização dos erros de predição e a chamada Inferência Ativa possuiriam na manutenção homeostática de nossos cérebros e corpos preditivos. Por fim, forneceremos uma síntese de algumas consequências daquilo que o PP poderia trazer à compreensão contemporânea do cérebro e comportamento humanos, concluindo que, embora sua descrição da cognição como um processo preditivo único e contínuo prometa eventualmente unificar paradigmas explicativos e níveis de análise distintos, por ora, talvez seja melhor concebê-lo de forma mais modesta, como uma ferramenta ou heurística para nos auxiliar a repensar vários dos tópicos centrais ao estudo científico e filosófico da mente. O presente artigo pretende explorar a máxima contida em Os irmãos Karamázov (se não há Deus, tudo é permitido?) à luz do pensamento de Immanuel Kant. Para tanto, se vale do pensamento de Dostoiévski apenas na medida em que ele serve como auxílio na apresentação da ideia de Deus e de sua relação com a posição do ateu. Tendo em vista a filosofia kantiana, buscamos não apenas a apresentação dessa ideia, mas também sua relação com o ato moral e com (...) a própria condição desse ato. Isso, portanto, resultará em Kant, uma resposta duplamente negativa à pergunta que reflete a posição ateísta de Ivan Karamazov. Pois Kant ao distinguir o ato moral por dever e conforme o dever, defende que recorrer a algo externo à razão (Deus) constituiria uma vontade meramente heterônoma. Portanto, o ato moral por excelência ocorre quando a ação é realizada de um modo unicamente guiado pela razão, com base num interesse puro, e isso conduz, por sua vez, à reprovação por parte de Kant da referida máxima presente na obra de Dostoiévski. The rationality of the human being applied in science-technique in the contemporary capitalist system is distorted; the purpose, which is the good life for human beings, has become the means to sustain and feedback the technicist system of technological capitalism. Thus, the modus operandi of science, aims only to legitimize technology, apart from the ethics applied in this relationship between technology and human beings, and cut off from critical philosophical thinking. With the result presented, the problem lies in the reason (...) of the contemporary human being, who seeks to satisfy his desires and envisions the good life (eudaimonía) in material goods, suppressing the contemplative leisure of life (ataraxia); becoming a slave to the system it fosters. The objective is to demonstrate the need to reformulate the modern system, in order to earn a good life for human beings as a purpose of technical science, which should be the means for this and as technological advances in favor of the quality of human beings. and, not for capitalist reproduction. The research methodology is an exploratory bibliography, exposing and dialoguing with authors on the subject in order to forge our conclusion, that pleads for science-technical that enjoys ethics and human reason in favor of eudaimonia. This is a critical review of Herman Cappelen’s Fixing Language (2018), an excellent and thought-provoking introduction to a hot topic in metaphilosophy: conceptual engineering, which defines the process of evaluating and improving/revising our representational devices (popularly known as concepts). Here, I first present an overview of the book, summarizing his General Theory of conceptual engineering. Second, I point out some limits of the General Theory, in particular the putative consequence of his semantic externalism, the Lack of Control thesis. According to (...) it, the processes behind changes in meaning are too complex and amorphous for revisionary projects to be generally successful. However, I claim that a proper investigation of Lack of Control demands us to look at the sciences, especially the social sciences, something absent in Cappelen’s book. Furthermore, I remember that many conceptual engineers do not put forward large-scale revisions, but rather local ones – i.e., restricted to specific scientific and institutional contexts, and therefore more feasible and potentially relevant. Aunque se singulariza el análisis para el caso de la sociedad cubana, el texto desarrolla ideas metodológicas aplicables al estudio de la democracia como valor en otras sociedades. A diferencia de otros estudios sobre el tema, el presente trabajo aplica al estudio de la democracia una concepción pluridimensional de los valores, buscando delimitar el contenido del valor democracia en las dimensiones instituida, subjetiva y objetiva. Education is essential to life, and the epidemic affected everything. Parents want to get their kids the most important teaching. However, since COVID-19 has affected schools and other institutions, providing education has become the most significant issue. Online learning pedagogy uses technology to provide high-quality learning environments for student-centered learning. Further, this study explores the experiences and challenges faced by Filipino tertiary students regarding the lack of gadgets amidst online learning. Employing the Interpretative Phenomenological Analysis, the findings of this study (...) were: Some college students still have difficulty with online learning. Attending online classes is difficult, especially for students with limited resources. Smartphones, other gadgets, and internet connections play a significant role in online classrooms because they are the ones that students utilize while learning online, which is essential for successful participation in online higher education as well as for solving a variety of other difficulties in the new normal. Further, College students face similar health challenges. Having an online learning setup is not just about students' struggles with learning resources but also about their health issues. When our respondents used their smartphones for an extended period, they reported eye aches and blurred vision. They also said that some of their body parts, such as their legs and back, are aching, and feel pressured because they tend to overthink things in their surroundings, which causes them incredible difficulty in performing their best in attending online classes. Even though college students continue to suffer from a lack of learning resources during online sessions, they do their best to manage their needs and the scarcity of learning resources. Students have unique coping methods for dealing with difficulties in online classes. (shrink)

El presente estudio ofrece, desde una perspectiva teórica, una breve visión de conjunto de la concepción tomista sobre las emociones, su encaje en el ciclo de la vida consciente, su génesis, su clasificación, su encadenamiento y su dinamismo. Desarrolla consideraciones sobre las contribuciones que este referencial teórico puede aportar al estudio de las emociones y deduce algunos de sus principales corolarios éticos.

This paper develops an account of normative validity and illustrates it through poverty measures. Many ideas addressed below are legatees of Anna Alexandrova’s reflections on what she called “value-aptness” in measuring well-being. To my knowledge, she introduced the term “normative validity” (Alexandrova, 2017: 151). Still, my goal is to address normative validity in a broader context than she did, highlighting its significance not only for well-being but also for other concepts, particularly poverty. I will further discuss how normative validity can (...) provide deeper insights into an important debate in poverty measurement: that between normative-driven approaches like Amartya Sen’s and data-driven ones like Peter Townsend’s. This book aims to examine the contributions that beauty (pulchrum in Latin) can offer to the educational activity, focusing on the subject from the point of view of Thomistic Psychology. For this, comes to answering some previous criterial and methodological objections to recall thereafter the main points of that psychological conception. The book presents what this conception understands as human powers, their interaction and dynamism, the role of emotions in the latter, and the processes arising from such interaction. In succession, (...) it analyzes the interaction of these powers amongst themselves and with the transcendentals of being, as well as the catalytic role that the pulchrum can have on those processes, placing them in synergy, particularly for the formation of personality and character. The book examines, then, the relations of this synergy with the essence of learning, the contributions that this later can receive from the Thomistic conception of person and their relationship with the proper use of pulchrum in education. And concludes with the didactic efficacy that results from the confluence of all these factors, its positive consequences for the various forms of educational activities and for life in society, as well as opening an invitation to the development of research in this area. This book presents a course in General Psychology which offers, in a synthetic form, a general vision of contemporary Psychology, added by contributions that the Thomistic Psychology provides. Develops the basic concepts of psychological science, its study methodology, its historical evolution, the role of biological, psychological and social components that influence the behavior, beyond the study of psychopathology and therapy, comparing them always with the Thomistic approach.

This book offers an analysis of the different concepts of person adopted in educational strategies, their effects on learning, and the contributions of the Thomistic approach on the issue.

Taking as an assumption the existence of an informatics revolution nowadays and that the examination of studies and debates related to it may allow the identification of questions of a philosophical nature, the present study aims to identify and formulate some of these questions, as well as to investigate whether the historical controversy about monopsychism, which occurred at the University of Paris in 1270, can be considered a theoretical framework capable of providing contributions to these philosophical questions. The answer to (...) this research problem may be positive, insofar as the aforementioned theoretical framework allows to identify contributions to the solution of the above mentioned questions. During much of the past century, it was widely believed that phonemes--the human speech sounds that constitute words--have no inherent semantic meaning, and that the relationship between a combination of phonemes (a word) and its referent is simply arbitrary. Although recent work has challenged this picture by revealing psychological associations between certain phonemes and particular semantic contents, the precise mechanisms underlying these associations have not been fully elucidated. Here we provide novel evidence that certain phonemes have an inherent, non-arbitrary emotional (...) quality. Moreover, we show that the perceived emotional valence of certain phoneme combinations depends on a specific acoustic feature--namely, the dynamic shift within the phonemes' first two frequency components. These data suggest a phoneme-relevant acoustic property influencing the communication of emotion in humans, and provide further evidence against previously held assumptions regarding the structure of human language. This finding has potential applications for a variety of social, educational, clinical, and marketing contexts. (shrink)

: En el trabajo se busca constatar y analizar los fundamentos de la simbiosis armoniosa que se da entre lo poético y lo filosófico en el pensamiento de José Martí. Tal imbricación la encontramos no sólo en él. Ha llegado a ser bastante frecuente en un contexto como el latinoamericano. Pero, tal vez sea en Martí en quien esa fusión se acrisola de manera más brillante. Nunca se preocupó demasiado por el contenido filosófico de su poesía ni por la (...) forma poética con que vertió sus pensamientos más profundos y de mayor alcance. O, dicho de manera más exacta, sí se preocupó, y mucho, porque lo uno y lo otro nunca estuviera ausente. Y por esa misma razón fue siempre más que poeta y más que filósofo, fue escritor y pensador, o como prefirieron llamarlo sus contemporáneos, fue maestro, en cualquier caso, universal, con todas las posibles acepciones que a este último término pueda otorgársele, excepto de aquella que asume la universalidad como el despego de lo propio y particular. Eso sí no lo encontraremos en Martí. En ningún momento olvidó, no importa el lugar donde se encontrara, que escribía y pensaba desde y para su colonizada Cuba y desde y para su también sufrida América. (shrink)

Este trabajo pretende mostrar las líneas generales de la propuesta humeana de una teoría de la evolución de las instituciones en clave utilitarista; en segundo lugar, analizará la objeción interna a esta teoría que supone la existencia de posibles sujetos no cooperadores pero inteligentes, en tercer lugar, intentará también defender dicha teoría de la acusación externa de no tener un auténtico carácter normativo; y al no haber desarrollado el propio Hume con detalle su contestación al problema del conflicto Moral/Racionalidad, tal (...) y como surge en el contexto de su discusión de la Knavery, finalmente, y en cuarto lugar, este trabajo, yendo en un cierto sentido algo más allá de lo propuesto por Hume, ensayará un argumento post-humeano en torno a ese conflicto, basado, por una parte, en el reconocimiento de la multidimensionalidad de la Moral, así como en la paralela aceptación de la necesidad de un ajuste contextual de ésta, asentado sobre consideraciones primaria, que no exclusivamente, utilitaristas. In debating the ethics of immigration, philosophers have focused much of their attention on determining whether a political community ought to have the discretionary right to control immigration. They have not, however, given the same amount of consideration to determining whether there are any ethical limits on how a political community enforces its immigration policy. This article, therefore, offers a different approach to immigration justice. Freud uses paradoxical and conflictual rhetoric to create an unstable and conflictual picture of the mind. Thus he diverges from both dominant traditions of thought in the West: the Judeo-Christian way of filling all gaps in meaning by putting a single omnipotent divinity in charge of them, and the Enlightenment quest for a final, causal language to describe reality. By both suggesting and displacing a plurality of perspectives on the unconscious, Freud’s text mirrors what it claims happens in our minds, (...) in which unconscious impulses undermine the pretense of total rational self-control. Though Freud suggests that a mechanistic description of the mind may bring us nearer to the reality of the unconscious, he also explains that this reality will remain dark. He not only develops an ostensibly mechanistic vocabulary for unconscious mental processes, but also clarifies that his terminology is most fictional precisely when it seems most scientific. Hence, Freud’s science of the unconscious cannot be assimilated to an empiricist position; its philosophical underpinnings are both Kantian and Nietzschean, with metaphors and analogies playing a crucial role. Two dramatic images, in which the mind appears as a domain of warring gods and a realm of political conflict, demonstrate that Freud did not regard the unconscious as some kind of true inner self. He depicts the mind in general and the unconscious in particular as a pagan, conflictual universe over which no god or goddess can gain exclusive control and where no rigid dictatorship is possible. The idea that thoughts are structured is essential to Frege's understanding of thoughts. A basic tenet of his thinking was that the structure of a sentence can serve as a model for the structure of a thought. Recent commentators have, however, identified tensions between that principle and certain other doctrines Frege held about thoughts. This paper suggests that the tensions identified by Dummett and Bell are not really tensions at all. In establishing the case against Dummett and Bell the paper (...) argues (a) that Frege was committed, in virtue of his doctrine of decomposition, to the thesis that a single sentence can express a range of thoughts, and (b) that Frege was committed, in virtue of his views about truth, to the thesis that a single thought can be expressed by structurally different sentences. But neither of these theses comes into conflict with the basic principle. (shrink)

The ArgumentThis essay examines Freud's construction of a mythical moment during early childhood, in which differences between male and female sexual identities are said to originate. It focuses on the way in which Freud divides fear and envy between the sexes, allocating the emotion of fear to men, and that of envy to women. On the one hand, the problems of this construction are pointed out, but on the other hand, it is shown that even a much-maligned myth may still (...) provide food for thought.Then, four critiques of Freud which have been articulated by prominent feminist psychoanalysts – Karen Horney, Nancy Chodorow, Luce Irigaray, and Jessica Benjamin – are presented, as well as the alternative visions of sexual identities which these thinkers have developed. The basic metaphors or economies guiding these visions of sexual difference are appraised in terms of their breadth and depth, with particular reference to their ability to acknowledge and integrate the presence of fear and envy as passions which are evoked but also repressed in the face of sexual difference.From this angle, the contributions of Nancy Chodorow and Luce Irigaray are found to be more limited than those of Karen Horney and Jessica Benjamin, since the former two theorists allocate fear primarily or exclusively to men, as Freud has done, while they remain completely silent on envy. Differences in the scope or reach of the four feminist approaches are explained as a result of the theorists' differing perceptions of the social, political, and cultural position of women in patriarchal society. This essays argues that Freud’s vision of the rule of law may be worthwhile pondering by legal scholars. It can heighten awareness of its unconscious dimensions and point to a variety of ways in which the law functions as part of culture or civilization, rather than as a system with its own rules. The first two parts of the essay seek to reconstruct Freud’s notion of the rule of law as a dialectical or paradoxical civilizatory force, restraining the passions even (...) though they drive it. These two parts retrace Freud’s genealogy of the law’s prehistoric origins and unconscious dynamics, which can be found in Totem and Taboo and, in summary form, in Moses and Monotheism. Then, the third section critically assesses the problems and limitations of some of the uses legal scholars made of Freud’s genealogy. Finally, the essay returns to the intellectual context of Freud’s conception of the rule of law, concluding with the claim that a Freudian perspective implies, in fact, that legal studies should be conceived as cultural studies. This article focuses on the dialectic of metapsychology and hermeneutics in psychoanalysis. By combining the causal language of the former with the intentional terminology of the latter, Freud's discourse continuously transgresses narrowly conceived boundaries of scientific disciplines and places its stakes both in the humanities and the natural sciences. The argument is made that attempts to reduce psychoanalytic theory to either causal explanation or interpretation of meaning, turn it into a closed thought-system and rob it of its vitality. Moreover, it (...) is argued that although Freud understood himself to be a scientist, by eschewing the dichotomous reductionism characteristic for both his orthodox followers and critics who try to turn psychoanalysis into either a natural-science-like discipline or a hermeneutics, Freud demonstrated that his self-understanding was far more sophisticated than either of these two groups admit to. This argument is supported by a detailed discussion of Freud's epistemological premises, his conception of science and reality, and, especially, the place which Freud allocated to metapsychology in his interdisciplinary science. It is claimed that metapsychology served Freud as a double-edged sword, both enabling creative and metaphorical thought about the mind's hidden reality, and revealing the necessary incompleteness of hermeneutics. The article concludes with the claim that psychoanalysis needs metapsychology in order to pursue this dual task. (shrink)

This Article shows how three modern English thinkers — Hobbes, Locke and Bentham — construe the law as an intersection of secular eternity on the one one hand and transience in modernity on the other, allowing for immovability and movement at the same time, combining stability with change. It details how these theorists, who undoubtedly have earned themselves places of honor in the canon of modern political thought, tried to solve the problem of self-grounding in three different and yet paradigmatically (...) modern ways, each of them intertwining law and time in a different fashion, and each of them connecting both law and temporality to happiness. Thus this Article shows not only that these three British thinkers claim in one way or another that while natural desires may provide pleasure, only the law can bring happiness, but also emphasizes that, in their view, the transformation of the former into the latter entails a transformation of temporal consciousness. Thereby this Article foregrounds two elements that are crucial to an understanding of how seventeenth and eighteenth century British thinkers envisaged the transformation of pleasure into happiness by means of the law: first, the notion that the law creates or reinforces duration in social life, and second, the idea that the law can harness the immediacy of desires by assuring the legal protection of enduring pleasures, which lead to happiness. This essay discusses various representations of Eichmann's mind that were fashioned on the occasion of his trial in Jerusalem in 1961. Gideon Hausner the prosecutor presented the defendant as demonic. Hannah Arendt, the German-born American Jewish philosopher portrayed him as banal or thoughtless. Limiting themselves to the issue of mens rea in their judgment, the Israeli Supreme Court justices described Eichmann's mind as controlled by criminal intent. While these views have been widely discussed in the literature, much of this essay (...) focuses on a hitherto little noted perspective on Eichmann's mind that was formulated by the mental health experts who examined Eichmann for the prosecution. As compared to the inclusionist, confictual, and complex picture these experts presented of Eichmann's mind, Arendt's and Hausner's views appear similar in their reductionism, rather than diametrically opposed, while the approach of the Supreme Court justices to Eichmann's mind can be regarded as restrictive. Methodological problems involved in all these different perspectives are discussed, and it is argued that even though the psychological outlook declares itself to be non-judgmental, it does, in fact, entail a dimension of moral judgment. Finally, Eichmann 's recently declassified memoirs are adduced and interpreted as lending some support to the psychological, inclusionist perspective on Eichmann's mind. (shrink)

Philosophers have assumed that as long as discriminatory admission and exclusion policies are off the table, it is possible for one to adopt a restrictionist position on the issue of immigration without having to worry that this position might entail discriminatory outcomes. The problem with this assumption emerges, however,when two important points are taken into consideration. First, immigration controls are not simply discriminatory because they are based on racist or ethnocentric attitudes and beliefs, but can themselves also be the source (...) of social and civic ostracism. Second, by focusing so much on questions of admission and exclusion, philosophers have tended to overlook the discriminatory potential of immigration enforcement mechanisms. In this essay, I make the case that philosophers who deal with the issue of immigration cannot dispense with the potential for discrimination in a state's enforcement mechanism as easily as they have with the potential for discrimination in a state’s admission and exclusions criteria. In addition, I put forth the positive claim that the way to combat this potential for discrimination (e.g., xenophobia) must begin with a defense of, and advocacy for, immigrant rights. (shrink)

O artigo parte da enunciação da tese de que ao desejo desmesurado dos grandes pela apropriação/dominação absoluta opõe-se um desejo não menos desmesurado e absoluto do povo de não sê-lo: dois desejos de natureza diferente que não são nem o desejo das mesmas coisas nem desejo de coisas diferentes, mas desejos cujo ato de desejar é diferente. Considerando que cada desejo visa sua efetividade absoluta, cada um tenta impor-se universalmente tornando-se duplamente absoluto: por um lado tende à dominação total (os (...) grandes) ou à liberdade plena (o povo); por outro, tenta se impor ao conjunto do corpo político. Cada desejo somente se sustenta do desejo que lhe é heterogêneo. Cada um persegue uma finalidade própria cuja realização plena será a ruína de toda vida coletiva. Boas instituições e boas leis asseguram a liberdade na medida em que forem capazes de impedir que grandes ou povo consumam seu desejo ou que abandonem seu desejo próprio para assumir o do outro. Contudo, ao inscrever a ordem da lei na desordem dos dissensos, Maquiavel descartou a idéia de uma ordem institucional como solução definitiva da desordem dos dissensos. Conseqüentemente, nenhuma lei ou instituição é capaz de resistir definitivamente ao risco da corrupção. Isso obriga ao retorno periódico às origens: a experiência do momento constitutivo da violência originária que, expondo os homens ao risco, restaura o prestígio e vigor iniciais de Estados e instituições. In the attempt of defending an interpretation of David Hume's moral and political philosophy connected to classical utilitarianism, intervenes in a key way the so called problem of the " Sensitive Knave " raised by this author at the end of his more utilitarian work, the Enquiry Concerning the Principles of Morals. According to the classic interpretation of this fragment, the utilitarian rationality in politics would clash with morality turning useless the latter. Therefore, in the political area the defense of (...) a moral utilitarianism would be an auto contradictory task. In order to show that, first, Hume does not say anything similar to this and second, that even indicates the way of overcoming this apparent contradiction between morality and rationality, we analyze briefly the arguments from which there comes basically this "anti-utilitarian" standard interpretation, and we defend an interpretation of the humean discussion on the problem of the supposed conflict between morality and rationality, or of rational incentives for immoral behavior, which allows to explain better Hume's position on this problem. Finally, we propose an instance of overcoming the contradiction morality/ rationality by a rule adjusted utilitarianism centered on the idea of the "progressive development of artificial institutions of reinforcement of morality", that Hume himself would suggest in other places in which he approaches the topic of the apparent contradiction between "morality" and "knavery". We propose also possible lines of future development of this idea, between them its use to clarify the relation of David Hume's thought with certain forms of contemporary liberalism. (shrink)

The purpose of this thesis is to make explicit the specificity of the following themes: the Bildung (formation/cultivation), education (Erziehung) and experimentation [Experimentieren – Erlebnis (experience)] in Nietzsche’s thought. As for that, it sustains that Nietzsche’s abandonment movement of the formation concept in favor of the notion of education and the subsequent substitution of education by the theme of experimentation, revealed a wide process of conceptual modification through which the author develops a radical theory of the constitution of the human (...) being. There are three distinct, although connected, moments of this process: the first one (chapters 1 and 2) in which the formation theme, not only in Nietzsche’s but in all the German tradition of the eighteenth and nineteenth centuries, is linked to discussions on the educational and formative value of art. For this reason, after presenting a contextualization of the relation between art and formation in the German tradition (chapter 1), it is presented (chapter 2) Nietzsche’s relation – the way it happens in his first important piece of writing The Birth of Tragedy – with the German aesthetic theories that reflected on the Greek culture, more specifically, on the problem of tragedy. Besides showing the influence of these theories on Nietzsche’s idea of formation, it is also shown the particularity of this idea and the elements that enabled the author to criticize the image of Greek serenity. Such critique happened due to the acknowledgement of an irretrievable split between public, art and culture in the Germany of the nineteenth century; the second one, (chapter 3), situated between his first important piece of writing, The Birth of Tragedy, and the extraordinary change of his thought, represented by the work Human, All too Human, is concerned about the problem of the authentic personality formation. In this period, the reflection on the authentic personality formation or the genius formation occurs in two distinct, although complimentary, registers: the first one, of analysis and critique of German teaching institutions, carried out in the five conferences delivered by him in the University of Basileia; and a second one, in which Nietzsche, based on his own experience with Schopenhauer, shows the dangers, the difficulties as well as the peculiarities of the formative experience to which one is submitted in the presence of a true philosopher. At last, the third moment (chapter 4), in which, based on the works produced after Human, All too human, the transformations of Nietzsche’s idea concerning the constitution of the human being are presented, characterized by the abandonment of the notion of formation, by the temporary use of the notion of education and by the choice of the experimentation notion as the most adequate to express the radicalism of the human being constitution process. The experimentation theme is presented in two registers: in the first one (in the first three items of chapter 4), based on Human, All too human; The Dawn and The Gay Science, it is shown the relation between the formation theme and the metaphysics critique based on the valorization of history, psychology and moral analysis; in the second one (in the last two items of chapter 4), it is reached the most advanced and radical formulation of Nietzsche’s thought on the theme of the human being constitution. Since the breach of the novel of self-cultivation (Bildungsroman) in Thus Spoke Zaratustra, dealing with the training and selection theme in On the Genealogy of Morality, to the establishment of figures of the overman and the sovereign individual, it is always focused an imperious obligation, which is to refer the theme of the human being constitution to the notion of experimentation that shows up under the sign of the concept of time and the solitude experience.
